Grounds for appeal
Identify a specific factual mistake, overlooked material already supplied, misapplication of the published criteria, undisclosed conflict or material procedural failure. Disagreement with an outcome alone is insufficient; explain how the alleged error could affect it.
Refer to the original record
Give the entry reference, decision date, exact finding challenged, evidence file and page references, requested correction and supporting explanation. Keep the submission focused on the grounds rather than resending the whole dossier.
Submission window
Submit within 30 calendar days of notification of the decision. Explain any exceptional reason for a late request. Acknowledgement confirms receipt, not that the appeal has been upheld.
Independent assignment
An unconflicted person who did not make the original decision checks the grounds and assigns appropriate expertise. Original reviewers may be asked for an explanation but do not decide the appeal.
Reasons and outcomes
The outcome may confirm the original decision, correct a factual or procedural matter, or require reassessment. The applicant receives reasons and any effect on the award record. An order or purchasing history has no role in the outcome.
A new product or new evidence
Material created after the original decision, a changed formulation or a substantially wider use claim normally belongs in a new or revised application. Read Appeals and use the appeal link in your account decision.
